Please read these Terms of Service ("Terms") carefully before using the Nexus AI website at nexusai-sd.com or our AI business automation services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing our website or signing up for a Nexus AI plan, you represent that you are at least 18 years old, have the authority to enter into this agreement on behalf of your business, and agree to comply with these Terms.
2. Description of Services
Nexus AI provides AI-powered business tools including but not limited to: AI phone receptionist, business automation workflows, lead generation tools, document processing, web design services, and advertising audits. Service features and availability may change over time.
3. Subscriptions and Payment
- Subscription plans are billed monthly or as otherwise specified at sign-up
- Payments are processed securely through Stripe; we do not store payment card data
- All fees are non-refundable except where required by law or expressly stated in your plan
- We reserve the right to change pricing with 30 days notice
- Failed payments may result in service suspension
4. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period. To cancel, call (605) 709-0930, use our contact form, or cancel from your dashboard.
5. Acceptable Use
You agree not to use our Services to:
- Violate any applicable law or regulation
- Harass, spam, or deceive end users or customers
- Infringe on the intellectual property rights of others
- Attempt to reverse-engineer or circumvent our systems
- Transmit illegal, harmful, or misleading content
6. Your Content
You retain ownership of content you provide to us. By using our Services, you grant Nexus AI a limited license to process your content solely to deliver the Services. We do not use your business data to train AI models without your explicit consent.
7. Intellectual Property
All content on nexusai-sd.com — including text, graphics, logos, and software — is the property of Nexus AI or its licensors and is protected by applicable intellectual property laws. You may not reproduce or redistribute our content without written permission.
8. AI-Generated Content Disclaimer
Our AI receptionist and automation tools generate responses autonomously. While we strive for accuracy, AI-generated content may occasionally contain errors. You are responsible for reviewing AI outputs and ensuring they meet your business standards. Nexus AI is not liable for business decisions made based on AI-generated responses.
9. Limitation of Liability
To the fullest extent permitted by law, Nexus AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use our Services. Our total liability to you shall not exceed the amounts paid by you in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Nexus AI, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your access to the Services at any time for violation of these Terms or for any conduct we determine to be harmful to other users or our business.
12. Governing Law
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Minnehaha County, South Dakota.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or through the Services. Continued use after changes constitutes acceptance of the updated Terms.
